Terms of Service — The Perfume Pulse
Effective date: 5 September 2026 Last updated: 9 September 2026
Provider: The Perfume Pulse Ltd (company number 17445863) Contact: admin@theperfumepulse.com
These Terms of Service ("Terms") are a legal agreement between you and The Perfume Pulse Ltd ("we", "us", "our") governing your use of The Perfume Pulse mobile application, our website at theperfumepulse.com, and the beta programme (together, "the App").
By creating an account, applying to the beta programme, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Our Privacy Policy explains what personal data we collect and why. It forms part of these Terms.
1. Who we are
The Perfume Pulse is a fragrance discovery and collection app developed and operated by The Perfume Pulse Ltd, a company registered in England and Wales under company number 17445863, whose registered office is 66 Paul Street, London, England, EC2A 4NA. We are the data controller for the purposes of UK and EU data protection law.
You can contact us at any time at admin@theperfumepulse.com.
2. Eligibility
You must be at least 13 years old to use The Perfume Pulse.
If you are under 18, you may only use the App with the involvement and consent of a parent or guardian, who accepts these Terms on your behalf and is responsible for any purchases made through your account.
You must also be able to form a binding contract in your country, and not be barred from using the App under any applicable law.
3. Your account
You need an account to use most of the App. When you create one you agree to:
- give accurate information, and keep it up to date;
- keep your password confidential, and not share your account with anyone else;
- tell us promptly at admin@theperfumepulse.com if you believe your account has been accessed without your permission.
You are responsible for activity that happens under your account. We are not liable for loss caused by someone else using your account where that happened because you did not keep your credentials secure.
You can delete your account at any time from within the App. Deletion is explained in our Privacy Policy.
4. The beta programme
Parts of the App are offered as a beta: a pre-release version provided so that we can test it and gather feedback.
You should expect beta software to behave accordingly:
- It may contain errors, and features may change or be removed without notice.
- Data you create during the beta may be lost. We take backups and we do not intend to delete your data, but you should not treat the App as the only record of anything you care about.
- It is provided free of charge. There are no subscriptions or payments during the beta.
- Feedback is welcome and unrestricted. If you send us feedback, bug reports, screenshots or suggestions, you allow us to use them to improve the App without obligation or payment to you. Please do not send us anything you consider confidential.
We may end the beta, or remove any participant from it, at any time.
5. Licence to use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and with the rules of the app store you downloaded it from.
We keep all rights not expressly granted to you. In particular, you may not:
- copy, modify, translate or create derivative works of the App;
- reverse engineer, decompile or disassemble the App, or attempt to derive its source code, except to the extent this restriction is prohibited by law;
- rent, lease, sell, sublicense or otherwise commercially exploit the App;
- remove or obscure any copyright, trademark or other proprietary notice;
- use automated means (scrapers, bots, crawlers) to extract our catalogue, tonal analysis or any other part of the App;
- use the App to build or train a competing product or dataset.
6. Subscriptions and payment
Some features may be offered as part of a paid subscription ("Premium"). No paid subscription is offered during the beta; this section governs Premium if and when you choose to buy it.
Pricing. Premium is offered at £8.99 per month or £85 per year. Prices are shown in the App before you confirm a purchase and may change; we will tell you in advance of any change affecting a renewal, and you can cancel before it takes effect.
Billing is handled by Apple or Google, not by us. Purchases are made as in-app purchases through the App Store or Google Play. We never see or handle your payment card details.
Auto-renewal. Subscriptions renew automatically at the end of each billing period, and your account will be charged for renewal within 24 hours of the end of the current period, unless you cancel at least 24 hours before it ends.
Cancellation. You cancel through your app store account — on iOS: Settings → your Apple ID → Subscriptions; on Android: Play Store → Subscriptions. We cannot cancel a subscription on your behalf, because Apple and Google control that process. When you cancel, you keep Premium access until the end of the period you have already paid for.
⚠️ Deleting your The Perfume Pulse account does not cancel your subscription. You must cancel it separately through the app store, or you will continue to be charged.
Refunds are handled by Apple or Google under their own policies, not by us. Requests should be made to them directly (Apple: reportaproblem.apple.com).
Free trials. If we offer a free trial, it converts into a paid subscription at the end of the trial unless you cancel before it ends. Any unused part of a free trial is forfeited when you buy a subscription.
Your statutory rights. If you are a consumer in the UK or EU you normally have a 14-day right to cancel a purchase of digital content. By buying and immediately accessing Premium, you ask us to begin supplying it at once and acknowledge that you lose that cancellation right once supply has begun. This does not affect your rights if the service is faulty or not as described.
7. Your content
You keep ownership of everything you put into the App — your collection, your notes, your layering combinations, the names you suggest for them, your feedback and any images you upload ("Your Content").
So that we can operate the App, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display Your Content for the purpose of providing the App to you and to the people you choose to share it with. This licence ends when you delete the content or your account, except where we must keep a copy to meet a legal obligation, and except for content you have shared publicly which others have already saved.
You confirm that you have the right to share anything you upload, and that it does not infringe anyone else's rights.
⚠️ If Your Content includes analysis the App generated for you — a layering combination, a recommendation or a prediction — remember that it was produced from your profile and does not transfer to the people you share it with. See section 9.1.
We may use aggregated and anonymised information — data that cannot identify you — to improve the App and our fragrance analysis.
8. Acceptable use
You agree not to use the App to:
- break the law, or encourage anyone else to;
- upload content that is unlawful, abusive, harassing, hateful, defamatory, obscene, or that infringes someone else's rights;
- impersonate anyone, or misrepresent your connection to a person or brand;
- harass, stalk or repeatedly contact another user who does not want it;
- interfere with the App's operation, probe or scan our infrastructure, or try to access accounts, systems or data you are not authorised to access;
- place an unreasonable load on our systems, or circumvent rate limits;
- upload malware or anything designed to cause harm;
- resell or redistribute our fragrance catalogue or analysis.
You can block other users from within the App at any time. If someone is behaving abusively, please tell us at admin@theperfumepulse.com.
9. Fragrance information, AI-generated content, and what it is not
This is the most important section in these Terms, so please read it.
The Perfume Pulse offers scent analysis, layering suggestions, skin-profile insights, and an AI voice assistant. These are generated automatically — partly by our own analysis of fragrance compositions, and partly by third-party AI language models — from public information, brand descriptions and your own answers.
They are suggestions and opinions, not statements of fact and not advice. Specifically:
- AI output can be wrong. It may misdescribe a fragrance, invent a note, or give inconsistent answers. Do not rely on it as authoritative — check anything that matters to you against the brand's own information.
- Product information may be inaccurate or out of date. Note listings, concentrations and release years come from public sources and brand material, and formulations change without notice. We are not affiliated with, endorsed by, or speaking for any fragrance house or retailer.
- It is not medical, dermatological, or allergy advice. Our skin-profile features describe how a fragrance may be perceived on different skin types. They are not a diagnosis, they do not assess whether a product is safe for you, and they must not be used to decide whether something will cause you a reaction.
⚠️ Fragrances contain ingredients that can cause skin irritation or allergic reactions. Always read the product's own ingredient list and warnings, patch test before applying a new fragrance to a large area, and stop using anything that causes a reaction. If you have a reaction, seek medical advice — do not rely on the App. Never use the App as a reason to use a product you have been advised to avoid.
You are responsible for what you buy and what you put on your skin. We do not sell fragrances, and any purchase you make is between you and the retailer.
9.1 Analysis is generated for you, and does not transfer to anyone else
Skin-profile insights, layering suggestions, wear and projection predictions and voice-assistant answers are produced from your own profile — your answers about your skin, your climate, your location and the fragrances you have told us you own. They describe how something may behave for you.
They are not general statements about a fragrance or about a combination of fragrances, and they do not carry across to anyone else. The same combination applied to a different person, with different skin, different sensitivities and different circumstances, may behave differently, may be unpleasant, and may cause a reaction that it did not cause for you. We have not assessed that person, and we cannot.
Accordingly, and to the fullest extent permitted by law:
- If you share output from the App — a layering combination, a recommendation, a wear prediction or anything else — whether through the App's social features or anywhere else, you do so at your own risk and you are responsible for what you choose to share. You should assume it will not have the same effect on the person you share it with.
- If you rely on output shared with you by another user, you do so at your own risk. It was generated for them and not for you, we did not review it before it was shared, and every warning in section 9 above applies to it in full. Treat it as you would a suggestion from a friend, not as advice from us.
- We are not liable for any loss, injury or damage arising from output of the App being shared with, or relied upon by, any person other than the user it was generated for.
Making a layering combination public does not mean we have checked it, endorsed it, or judged it safe or suitable for anyone.
⚠️ Nothing in this section limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded — see section 13.
10. Intellectual property
The App, its design, its software, and our fragrance analysis and tonal structure data are owned by us and protected by intellectual property law.
Brand names, product names and logos belong to their respective owners and are used for identification and descriptive purposes only. Their appearance in the App does not imply any affiliation with or endorsement by those owners.
If you believe something in the App infringes your rights, contact us at admin@theperfumepulse.com with details and we will investigate.
11. Availability and changes
We aim to keep the App available and working, but we do not guarantee it will be uninterrupted or error-free. We may suspend it for maintenance, updates, or reasons beyond our control.
We may change, add or remove features. If a change materially reduces what you have paid for, you may cancel your subscription as described in section 6.
The App depends on third-party services — including cloud hosting, AI providers and app stores — and their availability is outside our control.
12. Suspension and termination
You may stop using the App and delete your account at any time.
We may suspend or terminate your account if you materially breach these Terms — in particular section 8 — or where we are required to by law. Where it is reasonable to do so, we will tell you why and give you an opportunity to put things right first. If we terminate your account without cause while you hold a paid subscription, we will arrange a pro-rata refund for the unused period through the relevant app store.
Sections 7, 9, 10, 13 and 15 survive termination.
13. Disclaimers and limitation of liability
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any other liability that cannot lawfully be limited or excluded.
If you are a consumer, you have statutory rights under the Consumer Rights Act 2015 and other consumer protection law — including that digital content must be of satisfactory quality, fit for purpose and as described. Nothing in these Terms affects those rights. Nothing here requires you to give up a remedy you are entitled to by law.
Subject to that, and to the maximum extent permitted by law:
- The App is provided "as is" and "as available", and we do not guarantee that its fragrance information, analysis or AI output is accurate, complete or suitable for any particular purpose.
- We are not liable for loss that was not reasonably foreseeable at the time you accepted these Terms, or for business losses (lost profits, lost business, lost opportunity) — the App is for personal use.
- We are not liable for loss caused by third parties outside our control, including app stores, AI providers, hosting providers, retailers, or fragrance manufacturers.
- Where we are liable to you, our total liability in any 12-month period is limited to the greater of the amount you paid us for the App in that period or £100.
We keep backups, but you are responsible for keeping your own copy of anything you cannot afford to lose — particularly during the beta (section 4).
14. Apple App Store
This section applies if you downloaded the App from the Apple App Store, and Apple requires it:
- These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the App.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the App — including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- We, not Apple, are responsible for investigating and resolving any claim that the App infringes a third party's intellectual property rights.
- You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, on your acceptance, have the right to enforce them against you.
Your use of the App must also comply with the App Store Terms of Service.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
If you are a consumer resident elsewhere in the UK or in the EU, you keep the protection of the mandatory consumer laws of the country you live in, and you may bring proceedings in your local courts.
We would much rather resolve a problem directly. Please contact us first at admin@theperfumepulse.com and we will try to sort it out.
16. Changes to these Terms
We may update these Terms as the App develops. When we do, we will change the "Last updated" date above.
If a change materially affects your rights, we will give you reasonable notice — in the App or by email — before it takes effect. Continuing to use the App after that means you accept the updated Terms. If you do not accept them, you should stop using the App and may delete your account.
17. General
- Severability. If any part of these Terms is found unenforceable, the rest continues to apply.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours if the App is sold or reorganised, provided your rights are not reduced.
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the App.
